These Terms & Conditions govern all purchases made from Second Avenue, including through our website, www.secondavenue.co.nz. By placing an order, you agree to be bound by these terms.

1. Nature of Goods

You acknowledge that the goods you are purchasing are sample or secondhand items, which may have been previously worn. You are responsible for inspecting items for any signs of prior wear or defects before completing your purchase.

2. No Change-of-Mind Returns

Please choose carefully. We do not offer refunds, exchanges, or credits for change of mind.

3. Faulty Goods

If your item is faulty, it must be returned within 48 hours of receipt.

  • We will assess whether the item can be repaired, and will do so if possible.

  • If the item is not repairable, and your claim meets the criteria under the Consumer Guarantees Act 1993, we will issue a credit (not a replacement).

4. Acceptance of Terms

These Terms supersede all previous terms of trade and apply to all purchases and use of our services.
We may amend these Terms at any time by posting updated terms on our website. Your continued use of our services indicates your acceptance of the revised Terms.

If purchasing on behalf of a company or entity, you warrant that you are authorised to agree to these Terms on its behalf.

5. Availability and Supply

All orders are subject to product availability. If an item is unavailable after purchase, we will notify you via our website or email.

6. Delivery

  • We deliver to New Zealand & Australian street addresses only.

  • Delivery costs are additional and clearly stated at checkout.

  • We aim to dispatch items promptly after full payment is received.

7. Pricing & Payment

  • Prices are in NZD and include GST, unless otherwise noted.

  • Prices exclude delivery charges.

  • We reserve the right to change prices without notice.

8. Limitation of Liability

If you purchase our products for business purposes, the Consumer Guarantees Act 1993 does not apply. To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, or incidental damages.

  • Our total liability is limited to the value of the faulty goods.

  • No officer, employee, contractor, or agent of Second Avenue shall be held personally liable for any claim.

9. Governing Law

These Terms are governed by the laws of New Zealand.
All disputes shall be subject to the non-exclusive jurisdiction of New Zealand courts, regardless of your location.

You are responsible for providing accurate information and for any costs we incur due to errors (including legal costs on a solicitor-client basis).

10. Privacy & Confidentiality

  • We only send marketing communications if you opt in. You can unsubscribe at any time.

  • We may use your personal data for order fulfilment, payment processing, and customer support.

  • By using our site, you consent to our use of cookies. Disabling cookies may affect site functionality.

  • We may disclose your data if legally required to do so.

  • Confidential information will be handled appropriately, though we cannot guarantee website security.

11. General Provisions
